1. Presentation of the site.

Under article 6 of Law No. 2004-575 of June 21, 2004 on confidence in the digital economy, users of the FabGuys sites are informed of the identity of various stakeholders as part of its implementation and monitoring

2. General conditions of use of the site and the services offered.

The use of the FabGuys sites implies full acceptance of the general conditions of use described below. These conditions of use may be modified or supplemented at any time, users of the FabGuys site are therefore invited to consult them regularly.

This site is normally accessible to users at all times. An interruption due to technical maintenance may however be decided by FabGuys, which will then endeavor to communicate to users before the dates and times of the intervention.

The websites FabGuys is updated regularly by Carbonell Wilfried. In the same way, the legal notices can be modified at any time: they nevertheless impose themselves on the user who is invited to refer to them as often as possible in order to read them.

3. Description of the services provided.

The purpose of the FabGuys websites is to provide information on all of the company’s activities.

Carbonell Wilfried strives to provide as precise information as possible on the FabGuys websites. However, it cannot be held responsible for omissions, inaccuracies and deficiencies in the update, whether it is its own fault or that of the third party partners who provide it with this information.

All the information indicated on the FabGuys sites is given for information only, and is subject to change. Furthermore, the information on the FabGuys websites is not exhaustive. They are given subject to modifications having been made since they were put online.

4. Data collection

The information collected on this form is saved in a computerized file by FabGuys for data collection for the development of a virtual community database of meetings

They are kept for 8 months and are intended for the team of volunteer moderators and the technical team only. They are not sold or exploited by third parties. After 8 months if a user no longer logs in despite a reminder sent two weeks before, all of their data will be erased automatically. We keep NO record.

In accordance with the “IT and freedom” law, you can exercise your right of access to data concerning you and have them rectified by contacting the delegate responsible for personal data.

5. Contractual limitations on technical data.

The site uses JavaScript technology.

The website cannot be held responsible for material damage linked to the use of the site. In addition, the user of the site agrees to access the site using recent equipment, not containing any virus and with an up-to-date latest generation browser.

6. Intellectual property and counterfeits.

Carbonell Wilfried owns the intellectual property rights or holds the rights of use on all the elements accessible on the site, in particular the texts, images, graphics, logo, icons, sounds, software.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited without the prior written permission of: Carbonell Wilfried.

Any unauthorized use of the site or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L.335-2 and following of the Intellectual Property Code.

7. Limitations of liability.

Carbonell Wilfried cannot be held responsible for direct and indirect damage caused to user equipment, when accessing the Carbonell Wilfried site, and resulting either from the use of equipment that does not meet the specifications indicated in point 4 , either the appearance of a bug or an incompatibility.

Carbonell Wilfried cannot also be held liable for indirect damage (such as loss of market or loss of opportunity) resulting from the use of the FabGuys sites.

Interactive spaces (possibility to ask questions in the contact space) are available to users. Carbonell Wilfried reserves the right to delete, without prior notice, any content posted in this space that would violate the law applicable in France, in particular the provisions relating to data protection. If necessary, Carbonell Wilfried also reserves the right to challenge the user’s civil and / or criminal liability, in particular in the event of a racist, abusive, defamatory, or pornographic message, regardless of the medium used ( text, photography…).

8. Management of personal data.

In France, personal data is notably protected by law n ° 78-87 of January 6, 1978, law n ° 2004-801 of August 6, 2004, article L. 226-13 of the Criminal Code and the European Directive of October 24, 1995.

When using the FabGuys sites, the following may be collected: the URL of the links through which the user has accessed the FabGuys, the user’s access provider, the user’s Internet Protocol (IP) address.

In any event Carbonell Wilfried collects personal information relating to the user only for the need of certain services offered by the FabGuys sites. The user provides this information with full knowledge of the facts, in particular when he enters it himself. It is then clear to the user of the FabGuys sites whether or not to provide this information.

In accordance with the provisions of articles 38 and following of the law 78-17 of January 6, 1978 relating to data processing, the files and freedoms, any user has a right of access, rectification and opposition to personal data concerning him, by making his written and signed request, accompanied by a copy of the identity document with signature of the holder of the document, specifying the address to which the response must be sent.

No personal information of the user of the FabGuys sites is published without the user’s knowledge, exchanged, transferred, assigned or sold on any medium to third parties. Only the hypothesis of the repurchase of Carbonell Wilfried and its rights would allow the transmission of said information to the possible purchaser who would in turn be held under the same obligation to store and modify data with respect to the user of the sites FabGuys.

The databases are protected by the provisions of the law of July 1, 1998 transposing Directive 96/9 of March 11, 1996 on the legal protection of databases.

9. Hypertext links and cookies.

The FabGuys sites contain a certain number of hypertext links to other sites, set up with the authorization of Carbonell Wilfried. However, Carbonell Wilfried does not have the possibility of verifying the content of the sites thus visited, and will not therefore assume any responsibility for this fact.

Browsing the FabGuys sites may cause the installation of cookie (s) on the user’s computer. A cookie is a small file, which does not allow the identification of the user, but which records information relating to the navigation of a computer on a site. The data thus obtained are intended to facilitate subsequent navigation on the site, and are also intended to allow various measures of attendance.

10. Applicable law and attribution of jurisdiction.

Any dispute in connection with the use of the FabGuys site is subject to French law. Exclusive jurisdiction is given to the competent courts of Paris.

User: Internet user connecting, using the aforementioned site.

13. Right FabGuys on Google Playstore

Only the FabGuys.app application can use the site data via a web view within its application on the Google Playstore. FabGuys transfers the distribution rights and authorizes the use of its data.

 

Registration on the site constitutes knowledge and unconditional acceptance of this charter. This charter applies to all the sites of the FabGuys network: FabGuys.

Foreword:

Because the internet is not a lawless area, FabGuys is offered to you under certain conditions of use defining all of the relationships between you and the site. Your identification, presence, use and affiliation imply the acceptance and the respect without restriction of all the conditions appearing in these regulations. FabGuys may change or modify these conditions without prior notice. As far as possible, an announcement will inform of a modification of these rules on the forum and / or the home page.

Responsibility :

FabGuys is a community site welcoming members from 15 years old (For adoTolerant), 18 years old for (FabGuys). Minor members (under 18) must themselves ensure the agreement of their parents or legal guardians before registering. FabGuys cannot be held responsible for the comments or excesses of its members.

Each member is responsible for the comments he makes on the site and especially in the event that some are reprehensible. In the event of illegal acts (harassment, insults, threats, racism etc.) on the part of a member, the user will notify the moderation team through support, or directly by private message to a moderator, so that the facts are traced, investigated or even sanctioned.

However, since FabGuys cannot control all messages (in particular private messages) or all identities of subscribers, in no case may the user be able to turn against the site. The site may, if necessary, in the case of illegal behavior, inform the competent authorities. All members must behave respectfully in accordance with this charter and the regulations in force in France and / or in their country of accommodation.

The Chat:

In order to be able to chat in real time, FabGuys has a chat where all members can meet and discuss various serious or non-serious subjects, in a relaxed atmosphere. Because of its more spontaneous side, the chat is a little more free and light than the forum.
However, a chat is also not a lawless area and is subject to certain rules.
These are the same as the forum, with a higher tolerance on “light” topics. Do not hesitate to say hello, politeness is not inappropriate in this place.
The discussion is instant on a chat, pay attention to the turn of your sentences. These can be misinterpreted if their meaning is not obvious. It is better to respond with a few seconds delay than to create a conflict based on misunderstanding.
As in the forum, the use of capital letters is considered to be shouting, and therefore cannot be justified. A chat is not a place to settle accounts, so please avoid overbidding during a concern with a member. Like the forum, flooding is also prohibited. It is useless to relaunch the same sentence every second, a reaction is not obliged to be done the second following your intervention.
You can chat with the moderators during the chat, however it is forbidden to ask a moderator the reasons for a ban from another user. Because we can’t laugh at everything: So that FabGuys remains a place where it is good to live and converse, do not hesitate to put a touch of humor in your words. Be careful however, certain subjects can be difficult to approach with humor, especially since you do not necessarily know what the people with whom you are conversing have experienced.

In order to avoid confusion, and because it can be really dangerous, some subjects cannot be taken to the joke like suicide, rape, pedophilia, mst, genocides and drugs.

Each user undertakes to choose a correct color: neither too light nor too dark, so that everyone can interact correctly.

Moderation:

In case of non-compliance with this charter, FabGuys may take sanctions ranging from a simple warning to final banishment. Likewise, FabGuys reserves the right to apply security and control systems (eg filters) in order to protect its members from possible malicious intent.
